End-User License Agreement

This End-User License Agreement ("Agreement") is between you ("User") and LogMark ("we", "us") for the LogMark desktop application ("Software").

By installing or using the Software, you agree to this Agreement. If you do not agree, do not install or use the Software.

1. Alpha Software

This Software is in alpha. It is provided for early access and evaluation purposes. It may contain bugs, incomplete features, and breaking changes between versions. We make no guarantees about availability, stability, or future compatibility.

The alpha period may end or transition to a different licensing model. We will provide reasonable notice before any such change.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on your personal computer for its intended purpose: capturing, organizing, and reviewing personal notes and development logs.

You may not:

  • Reverse-engineer, decompile, or disassemble the Software
  • Redistribute, sublicense, or sell the Software
  • Remove or alter any proprietary notices

3. Your Data

Local-first design. Your vault data (entries, notes, logs) is stored on your local disk in standard Markdown files. The Software does not upload, sync, or transmit your vault content to any server.

Additive by design. The Software appends entries to files. It does not delete, overwrite, or destructively modify existing vault content during normal operation.

You own your data. Your vault files are standard Markdown. You can read, edit, move, or delete them with any text editor. Uninstalling the Software does not affect your vault files.

MCP server. The optional MCP (Model Context Protocol) server operates entirely locally. It reads and writes vault files on your disk. It does not communicate with any external server.

4. Telemetry and Network Communication

The Software communicates with our servers for limited operational purposes. See our Privacy Policy for full details. In summary:

  • Automatic: Installation event (once), daily heartbeat (version only), update check (version only)
  • Opt-in: Aggregated usage metrics (entry counts, command usage) - only if you explicitly enable analytics
  • User-initiated: Registration, feedback, bug reports - only when you choose to submit

No vault content is ever transmitted.

5. Third-Party Components

The Software includes third-party libraries and assets, each under their own license. See THIRD-PARTY-NOTICES.md installed alongside the Software for details. Avatar assets are derived from VPet-Simulator, licensed under Apache 2.0.

6. Disclaimer of Warranty

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

This is alpha software. Expect rough edges. We are actively developing and improving it, but we cannot guarantee it will work perfectly in all environments.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE.

Our total liability shall not exceed the amount you paid for the Software (which, during alpha, is zero).

8. Termination

You may stop using the Software at any time by uninstalling it. Your vault files remain on your disk.

We may terminate this license if you breach this Agreement. Upon termination, you must uninstall the Software.

9. Changes to This Agreement

We may update this Agreement with new versions of the Software. Continued use after an update constitutes acceptance. We will note material changes in release notes.

10. Governing Law

This Agreement is governed by the laws of the jurisdiction in which we operate, without regard to conflict of law principles.
